Slip on wet escalator due to bad weather

In June 2017, Mrs X was getting on an wet escalator at a metro station, when she slipped over as she stepped on it. The escalator was wet due to bad weather and other commuters walking in the area with wet shoes. Mrs X suffered soft tissue damage to her left ankle and bruising to her left knee. Liability was denied by the Third Party Solicitors as they stated all their inspections had been carried out as necessary for a wet day. Nevertheless, Personal Injury Advisor, RL, requested evidence of the checks performed on the day of accident. This evidence was not received from the Third Party Solicitors. Therefore proceedings were issued and an offer put forward in the sum of £5000.00. Then a counter offer was received for £4200.00. Mrs X was happy to accept this offer in respect of damages for her pain and suffering and her losses as a result of the accident. This settled without the need to go to trial. Commenting on the case Mrs X said ‘Russell Worth solicitors were very efficient throughout the process of my claim. They explained every stage of the process and always responded straight away to any queries. Very satisfied with outcome and would not hesitate to recommend them to anyone needing similar help.’

Fall from unmarked sunbed platform on holiday abroad

Mrs W suffered an injury whilst on holiday abroad. She had been sunbathing when she stood up from the sunbed and fell off the edge of the raised unmarked platform. The raised platform was overfilled with sunbeds, which left little room for Mrs W to manoeuvre off the sunbed with ease. Mrs W suffered a fractured wrist due to the negligence of the hotel. The holiday company’s Solicitors did not admit liability on the case. However, one of our Solicitors went on to negotiate an offer of £12000.00, for her pain, suffering and losses. Happy with the offer Mrs W commented, ‘Russell Worth Solicitors have been fantastic all the way through my claim. They kept me up to date every step of the way informing me of exactly what was happening. Even when I thought about giving up, Russell Worth kept my claim going, and now I have received my compensation which I am truly grateful for. Well done Russell Worth Solicitors!’

Mrs W kindly answered some further questions to help potential clients how might not be sure if Russell Worth are right for them.

What was your main reason for contacting Russell Worth? My main reason for contacting Russell Worth was that even though my accident had been several weeks previously I was still having a lot of ongoing pain and weakness from my fractured wrist and decided to make contact with a solicitor under a "no win no fee" basis as could not afford any large solicitor bill as only work part -time, and know costs could spiral out of proportion. What made you decide to choose Russell Worth? I chose Russell Worth as they specialise within the Devon & Cornwall area. How was your initial contact with Russell Worth? After my first phone call to Russell Worth, I was asked details of my accident to see if it was something that they could help me with. I also emailed a couple of photos of the incident area to help with as much information as possible. Within a short period of time - the next working day as was advised that they were willing to take on my claim. How was the service? Everything went well from the start, advised from the onset on how things would proceed, time scale and reassured of the no win no fee. I was informed every step of the way, even though at times I felt not continuing they never gave up on my case. What stood out as ‘above and beyond’ the expected service? So pleased with the outcome, my expectations were exceeded, and it was Russell Worth who did all the hard work!! What would you say to anyone else considering using Russell Worth? Russell Worth is the solicitors that I would recommend - very honest, trustworthy, and they know what they are taking on.

Road Traffic Accident Case Studies

Whiplash injury following road traffic accident

Miss W approached Russell Worth Solicitors following a road traffic accident in which her daughter, then aged 16, was injured. Miss W’s daughter, M, was travelling in a taxi when the driver failed to stop at a red light and collided with another vehicle. M, shaken following the accident, sustained a whiplash injury to her neck together with bruising to her face and headaches. BS, road traffic accident specialist here at Russell Worth, represented M (with her mother acting at Litigation Friend) in a personal injury claim and issued Court proceedings. Despite not admitting liability for the accident, the insurers for the taxi driver were keen to settle prior to a Court hearing in order to avoid the risk of losing the case at trial and incurring additional costs. M was offered an award of £3,400 to compensate her for her injury which BS advised was a good offer. Miss W, after discussing the offer with BS and M, accepted the offer on M’s behalf. The matter was then brought before a Judge who reviewed the injuries and the offer to ensure it was fair. Following the Judge’s approval, the compensation was then paid into the Court to be held on trust until M became 18 – as is standard practice. Commenting on the case, Miss W said the following “Russell Worth handled my daughters case extremely well from start to finish. Communications were excellent from all parties and we were well informed throughout. The barrister in court for the settlement hearing explained everything to us, and the whole process from accident to settlement took less than 18 months.”

Frightening RTA for front seat passenger

On 31st July 2015, Mrs P was a front seat passenger in a car when the driver lost control of the vehicle and crashed into a bollard. Mrs P sustained whiplash injuries together with headaches and torn muscles in her neck. As well as the physical injuries, Mrs P also suffered psychologically following the accident, feeling depressed and unable to sleep. Following a call to the National Accident Helpline, Mrs P’s case was taken on by our road traffic accident team. This was a lengthy case to settle as agreement could not be reached between the legal parties as to the accident details or the level of compensation to be awarded to Mrs P. NG, road traffic accident specialist here at Russell Worth, therefore took this matter to Trial and instructed a Barrister to represent Mrs P at Court. At Court, the Judge found in Mrs P’s favour and she was awarded over £8,000 for her pain and suffering which included an amount for her loss of earnings and medical expenses such as physiotherapy. Fortunately, Mrs P’s injuries were not permanent and she has been able to make a full recovery, putting this incident behind her. Commenting on the case Mrs P said the following:- “Very helpful and very professional. Russell Worth were there for me from the very start 2 years ago and helped me with my injuries and all enquires. Could not ask for a better company 10/10”
